Terms of Service

The short version. The plugin is free and yours. The website is a subscription you can cancel any time. Your song files and their locations stay on your machine. You are responsible for the music you play and the shows you run. We can only be held to what we charged you.

1. Agreement

FireballKaraoke.com (the “Service”) is operated by OIS Technologies, a Maryland company (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The plugin and the Service are separate

The FireballKaraoke plugin for VirtualDJ is provided free of charge and runs entirely on your own machine. It is licensed to you, not sold, for use with your own karaoke library. It does not require an account, a connection, or a subscription, and it keeps working whether or not you ever pay us anything.

These Terms govern the Service: the website, your account, and the cloud features that connect to it.

3. Accounts

The Service offers free singer accounts and paid host (KJ) accounts. You are responsible for activity under your account and for keeping your credentials secure. You must provide accurate information and be old enough to form a binding contract where you live. The Service is not directed to children under 13.

Names shown to a room are moderated. We may refuse or change a public name, a singer name, or a web address that is abusive, misleading, impersonates someone else, or creates a problem for a venue.

4. Subscriptions, trial, and billing

New host accounts include a one-month free trial. A payment method is required to start it, and nothing is charged until the trial ends. After the trial, host access bills on a recurring basis through our payment processor at the plan you chose.

You may cancel at any time. Cancellation stops future charges and takes effect at the end of the period you have already paid for, so you keep access until that date. Fees are non-refundable except where required by law, and we do not refund part of a period. The free trial is offered once per account.

When a subscription is not active, the cloud half stops: your rig can no longer open cloud request pages, and the host pages ask you to resubscribe. A show already running is not interrupted. The plugin is unaffected. We do not delete your data because you stopped paying.

5. Acceptable use

Do not misuse the Service: no unlawful, infringing, or abusive activity, no interfering with other people’s shows, and no attempts to breach security or reach data that is not yours. We may block a device from a show, or from the platform, when it is being used to abuse either.

6. Your shows, your music, your singers

You are responsible for the music you play and for holding whatever rights or licences your venue and your jurisdiction require. We do not supply, host, stream, or license karaoke tracks, and nothing about the Service grants you any right to content you do not already have.

You are responsible for the conduct of your shows, for anything you upload (photos, logos, venue artwork, show notes), and for how you handle the singer information your rig collects. If you send show reports to a venue, you are responsible for what you include and who you send it to.

7. Tips

If you list tip handles on your public page, we display links to the services you named. We are not a party to those payments, we never hold or process the money, and we take no part of it. The tipping service’s own terms apply.

8. Your content and your rig

You retain ownership of your data. The Service is additive to the plugin: your song files and their file paths never leave your rig. Per-rig backups are the one artifact that contains rig file paths and singer details; they are encrypted before they leave your machine, are private to the host, and are never shared with singers or other hosts.

You grant us only the permission we need to run the Service for you: to store, process, and display your content to the people you are showing it to.

9. Availability

We work to keep the Service reliable, but it is provided “as is” without guaranteed uptime, and we may change or discontinue features. By design, your live show does not depend on us: the plugin’s rotation, singer profiles, audience screen, and party features all keep working with no connection at all.

10. Termination

You may stop using the Service at any time, and you can delete a singer account from your profile page. We may suspend or terminate an account that violates these Terms or that creates risk for other users, for a venue, or for the platform.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages, including lost bookings or lost tips. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

12. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. Disputes are brought in the state or federal courts located in Maryland.

13. Changes

We may update these Terms as the Service evolves. Material changes will be communicated through the Service, and continued use after an update constitutes acceptance. The effective date at the top of this page tells you which version you are reading.
